1. About Our Service

Map The Gap Ltd ("we", "us", or "our") provides digital mapping interfaces that allow users to view geographical datasets and submit public opinions, text comments, and geographic shapes/geometries ("User Submissions").

2. Eligibility & Accounts

• Age Limit: You must be at least 13 years of age to use this platform and submit opinions.
• School and Educational Use: If the platform is accessed within a school, academy, or educational setting under the direction of an educator or institution, the age restriction of 13 is waived. In these circumstances, the educational institution acts as the Data Controller and guarantees that it has secured the necessary institutional or parental consents required under the UK GDPR before permitting students to input text comments or geometries. Map The Gap Ltd accepts zero liability for a school's failure to obtain such consents.
• Parental and Adult Guidance: Children under the age of 13 may use the platform outside of a school setting only if a parent or legal guardian creates the account, actively supervises the session, and explicitly inputs the submission on the child's behalf.
• Access Tiers: Access to certain projects may be free for a specific evaluation or consultation period. Following this period, continued use may require the creation of a registered account using a valid username and email address.
• Account Security: You are entirely responsible for maintaining the confidentiality of your login details.

3. User Content and Geometries

By uploading text comments, map pins, or drawing geometries on our interface, you grant Map The Gap Ltd a perpetual, irrevocable, worldwide, royalty-free license to host, store, aggregate, modify, and analyse your submissions.

• Anonymisation and Commercial Use: You acknowledge that your submissions will be displayed on visual maps. While raw data is restricted to project managers and team members, we reserve the right to commercialise, sell, or transfer the aggregated data to third-party organisations, clients, or councils. All such data will be strictly anonymised using system IDs to remove personal identifying markers in compliance with UK GDPR.
• No Expectation of Privacy in Opinions: Do not submit text or coordinates that reveal sensitive personal information or secrets.

4. Third-Party Data & OGL Disclaimer

• Data Sources: Our platforms display maps, boundary lines, and assets sourced under the UK Open Government Licence (OGL v3.0) or supplied directly by our corporate or public sector clients.
• No Liability for Errors: Map The Gap Ltd makes no guarantees regarding the accuracy, completeness, or currency of these underlying map layers. We accept zero liability for errors, omissions, or decision-making faults resulting from inaccurate OGL data, client data, or user-digitised boundary lines.

5. Content Moderation, IP Logging, and Termination

We and our designated project managers reserve the absolute right, at our sole discretion, to monitor, edit, refuse to post, or delete any User Submission (including text and geometries).

• Banning Policy: We and our project managers reserve the right to suspend or permanently ban users, block IP addresses, or terminate accounts at our absolute discretion, without prior notice or liability, for reasons including but not limited to spamming, abusive language, or uploading explicit content.
• IP Address Enforcement: We log IP addresses upon submission. If you breach these terms or engage in malicious behaviour, your IP address will be used to enforce platform-wide bans.
• Prohibited Content: Adult content, hate speech, defamation, and targeted harassment are strictly prohibited.

6. Limitation of Liability

To the maximum extent permitted by English law, Map The Gap Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of, or inability to use, our mapping platform. Your submissions are made entirely at your own risk.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
